Terms of Service
Introduction
These Terms of Service (“Terms”) govern access to and use of the website https://kirksrenovations.org and any services provided by Kirks Renovations (“we,” “us,” or “our”), a residential remodeling company based in Milton, Washington, serving King County, Pierce County, Bellevue, and surrounding areas.
By accessing our website, submitting a service request, or engaging our services in any form, you (“Customer” or “you”) acknowledge that you have read, understood, and agree that these Terms apply to all communications, estimates, proposals, and services unless superseded by a written Agreement signed by both parties.
Definitions
For the purposes of these Terms:
“Customer” means any individual or property owner requesting or receiving services from us.
“Services” means residential remodeling, renovation, installation, and construction-related work provided by us.
“Pricing Information” means any non-binding pricing ranges, budgets, or estimates provided prior to a written Agreement.
“Scope of Work” means the specific labor, materials, allowances, deliverables, and project requirements explicitly agreed upon in writing before work begins.
“Agreement” means a written contract or documented approval signed or confirmed by both parties that includes Scope of Work, Pricing Information, payment terms, and project conditions. Only an Agreement constitutes a binding obligation to perform services.
Scope of Services
We provide residential-only remodeling and renovation services, including kitchen remodeling, bathroom remodeling, home additions, accessory dwelling units (ADUs), and general residential construction work.
All Services are subject to availability, feasibility, site conditions, and final confirmation after consultation or site evaluation. We reserve the right to decline, suspend, or discontinue any project at our discretion, including but not limited to safety concerns, code compliance issues, or operational limitations.
Pricing Information and Contract Formation
All Pricing Information provided through our website, consultations, messages, or verbal discussions is non-binding and for informational purposes only.
Final pricing is determined only after full evaluation of Scope of Work, site conditions, material selections, labor requirements, and vendor input.
A binding Agreement is formed only when all of the following are confirmed in writing:
- Scope of Work
- final Pricing Information
- material selections or allowances
- payment terms
- project schedule or phases
No work shall begin, materials shall be ordered, or scheduling shall be committed without a fully executed Agreement.
Pricing, Adjustments, and Scope Control
All pricing is based on conditions and Scope of Work at the time of Agreement.
If during the course of work we encounter concealed, unknown, or differing site conditions (including but not limited to structural, electrical, plumbing, or framing conditions), such conditions shall not be included in the original Scope of Work unless expressly stated in writing. Any resulting changes will require a written change order prior to continuation of work.
No changes, additions, or deviations from the agreed Scope of Work shall be performed without prior approval. Unauthorized work will not be binding.
Deposits and Payment Terms
Certain projects require an upfront deposit prior to scheduling or commencement of work, particularly where labor scheduling, design coordination, or material procurement is required.
Accepted payment methods include cash, check, credit/debit card, and approved electronic transfers.
Payment Structure
Payment structure depends on project size and is categorized as follows:
- Small Projects (Limited Scope Work)
Payment is due upon completion unless otherwise stated in writing. A deposit may be required to secure scheduling or materials. - Standard Remodel Projects (Bathrooms, Kitchens, Mid-Scale Renovations)
An initial deposit is required prior to commencement. Progress payments may be required based on milestones such as material procurement, demolition, rough construction, and substantial completion. All payment stages must be satisfied before continuation of work. - Large Projects (ADUs, Home Additions, Full Remodels)
Projects are structured into phased payment schedules tied to defined construction stages such as pre-construction planning, permitting (if applicable), structural work, framing, mechanical rough-in, and final completion. Payment terms are defined in the Agreement.
Failure to make payments when due constitutes a material breach of these Terms and may result in work stoppage, project delay, withholding of materials, and/or enforcement of lien rights under Washington State law.
A ten percent (10%) non-refundable deposit applies to Kirks Renovations projects where a deposit is required and is considered earned upon scheduling and resource allocation.
Scheduling, Cancellations, and No-Shows
All scheduling is subject to mutual confirmation.
We reserve the right to apply cancellation or rescheduling terms based on project type and timing. Missed appointments or late cancellations may result in administrative fees or loss of deposit where applicable.
Changes to Scope (Change Orders)
Any modification to the Scope of Work must be approved in writing before execution.
Verbal approval may constitute authorization only if documented and confirmed. All change orders may affect pricing, timeline, and material selection and shall become part of the Agreement once approved.
Warranty
Kirks Renovations provides a workmanship warranty of up to ten (10) years depending on project type and scope, as expressly stated in the Agreement.
Warranty coverage applies only to work performed under the Agreement and excludes damage resulting from misuse, lack of maintenance, normal wear and tear, or modifications performed by others.
Limitations of Services
We reserve the right to decline, suspend, or discontinue work that falls outside our licensing, safety requirements, technical expertise, or operational feasibility.
We may engage qualified subcontractors or specialists to perform portions of the work. All subcontracted work remains under our coordination and must meet our quality and performance standards. Subcontracting does not alter the Customer’s Agreement with Kirks Renovations.
Communications and Consent
By submitting any form, contacting us directly, or engaging our services, you consent to be contacted by Kirks Renovations via phone, email, or text message regarding inquiries, Pricing Information, scheduling, and project-related communications.
We may also send limited follow-up communications related to prior inquiries or ongoing service relationships.
Intellectual Property
All website content, including text, images, branding, and project materials, is the exclusive property of Kirks Renovations and may not be copied, reproduced, or distributed without written consent.
Limitation of Liability
To the maximum extent permitted by law, Kirks Renovations shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:
- use of this website
- reliance on Pricing Information
- pre-contract communications
- or delays caused by site conditions, permitting, or third parties
Our total liability for any claim arising from Services shall not exceed the amount paid under the applicable Agreement.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States.
Any dispute arising from these Terms or Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington State.
Modifications to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our website or Services constitutes acceptance of the revised Terms.
